Privacy Notice: CellSPY Gateway Software

1. Introduction

This Privacy Notice applies specifically to Emsys Design’s “CellSPY” Battery Monitoring Gateway Software ("The Software") installed on-premise at the Customer’s facility. This notice distinguishes the data handling practices of the locally installed Software from Emsys Design's corporate website or other services.

2. No Data Transmission to Vendor

Emsys Design does not collect, transmit, or store data from this Software. The Software is designed as a standalone, customer-managed appliance. It does not automatically transmit battery metrics, user credentials, network configurations, or system logs to Emsys Design or any third-party cloud servers.

3. Local Data Storage

All data generated by the Software is stored locally on the hardware device (Gateway) or within the Customer’s private network infrastructure.

  • Battery Data: Voltage, temperature, and impedance readings are stored in the local SQL database.
  • User Credentials: Usernames and passwords (or authentication tokens) are stored within the local database or passed through to the Customer’s LDAP directory.
  • Logs: System and audit logs are retained on the local file system.

The Customer retains full ownership, control, and responsibility for this data.

4. Remote Access & Support

Emsys Design personnel do not have remote access to the Software.

  • Troubleshooting: In the event of a support request, the Customer may voluntarily choose to export specific log files or database extracts and share them with Emsys Design Support via email or secure file transfer.
  • Data Handling: Any data shared voluntarily for support purposes will be used solely to resolve the reported issue. Customer may request all data be deleted upon ticket closure.

5. Software Updates

The Software does not automatically push or pull updates from the internet. All firmware and software updates are initiated manually by the Customer. Emsys Design does not collect telemetry or usage statistics during the update process.

6. Customer Responsibilities (Data Controller)

As the entity managing the deployment, the Customer acts as the "Data Controller" for all information processed by the Software. The Customer is responsible for:

  • Configuring appropriate network security (Firewalls, VPNs).
  • Managing user access controls and password policies.
  • Ensuring compliance with local data privacy regulations (e.g., GDPR, CCPA) regarding the retention of any personal data (such as employee usernames) stored within the system.
